Terms of Use and Sale

These general terms (the “Terms”) govern access to the Backtrex platform and the purchase of Pro and Max lifetime licenses. They are entered into between you and Stemya Tech, a sole proprietorship registered under SIREN 881 895 478, with its registered office at 520 Route de Trévoux, 01600 Reyrieux, France. Payments are collected by Paddle.com Market Limited, acting as reseller (Merchant of Record). By creating an account, you accept these Terms in full.

Purpose of the service

Backtrex is an online platform for backtesting trading strategies. It lets you build strategies visually, test them on historical data and export the corresponding code. The service is a simulation tool intended for educational purposes: it is not investment advice, a personalised recommendation, or an inducement to invest.

Access to the service

Access requires an account with a valid email address. You are responsible for keeping your credentials confidential. The features available depend on the license you hold (Pro or Max); without a license, only the guided discovery tour is available.

Conditions of use

You agree to:

Use the service for its intended purpose (backtesting strategies)
Not attempt to circumvent the usage quotas of your license
Not share, assign or resell access to your account or your license
Not use the service for unlawful or fraudulent purposes
Not reproduce, decompile or create derivative works from the service
Not deliberately overload the infrastructure

Lifetime license: definition

The lifetime license is a personal right to use the Backtrex service, acquired with a single payment, with no subscription, no renewal and no later charge. It is attached to the account it was purchased with.

“Lifetime” means the lifetime of the Backtrex service, not that of its holder: the license gives access to the service for as long as it is operated by Stemya Tech or by anyone who takes over its operation.
The license is personal. It may not be assigned, resold or transferred to another account.
The license gives access to the features of the tier purchased (Pro or Max), as described in the “Usage quotas” section and on the offer page on the day of purchase. Whether features added to the service later are included in the license is stated when they launch.
Should Stemya Tech permanently stop operating the service, the license would end on the date of that shutdown. You would be informed by email at least three (3) months in advance, so that you can retrieve your strategies and the code you exported.

License numbering and price tiers

Each license receives a unique number, assigned in order of purchase, on a sequence shared by Pro and Max licenses.
Licenses are sold in successive tiers of fixed size. Each tier's price is shown before purchase and rises from one tier to the next. The number of licenses sold and remaining shown for the current tier reflects actual sales.
The price charged is that of the tier current when the payment page opens. If that tier fills up while you are paying, you keep the price you were shown.
A license's number and tier identify it. They may not be assigned or transferred and confer no right or benefit other than those described in these Terms. A withdrawn number, in particular after a refund, is not reassigned.
Licenses in the Founders tier were granted free of charge to existing users, on criteria set by Stemya Tech. They are not for sale.

Usage quotas

Each license includes the following usage quotas, counted per account and renewed every day:

Pro license: 20 backtests per day, 20 TradingView exports per day, 20 strategy imports per day, and 3 years of historical data.
Max license: backtests, TradingView exports and strategy imports with no daily quota, 10 years of historical data, and priority backtest processing.

Uses without a quota remain subject to reasonable use, consistent with the purpose of the service. Automated or massive use that compromises the availability of the service for other users (scripts, resale of access, data extraction) may be temporarily limited, after prior notice, except in an emergency affecting the security of the service.

The quotas above are those in force on the date of your purchase. They cannot be reduced for your license without your consent.

Price and payment

The license is sold on the following terms:

The price is paid once. No subscription is taken out, nothing renews and no later charge is made for the license.
Prices are shown excluding tax. The applicable tax is determined and collected by Paddle based on your country of residence and is added to the displayed price; the exact tax-inclusive amount is shown to you before you confirm your order.
The price depends on the current tier and may be adapted to your country of residence. The applicable price is the one shown on the payment page.
Payment is made through Paddle's secure platform. Backtrex stores no banking data.
The order becomes binding when payment is confirmed on the Paddle checkout page. A confirmation of your order is sent to you by email, together with the corresponding invoice.

Upgrading a Pro license to Max

A Pro license holder can move it to Max by paying the price difference, in a single payment. The license keeps its number and its tier.
The difference is calculated on the day of the request: the Max license price in the current tier, minus the price actually paid for the Pro license when it was paid in the same currency, or otherwise minus the Pro license price in the current tier. The exact amount is shown to you before payment.
The upgrade to Max is subject to the same conditions as the purchase of a license, including as regards the right of withdrawal.

Right of withdrawal

When you buy as a consumer and your purchase is billed in a country of the European Union or the European Economic Area, or in the United Kingdom, you have fourteen (14) days from the purchase to withdraw, without giving any reason and without penalty. The country taken into account is that of the billing address recorded at payment.

The license gives immediate access to the service. A notice next to the purchase buttons tells you so: by clicking to buy, you expressly request this immediate access.
This request does not make you lose your right of withdrawal: you can exercise it for fourteen (14) days from the purchase.
The simplest way is online, from your account: Settings, Billing, button "Withdraw from the contract here", then "Confirm the withdrawal". An acknowledgement of receipt is sent to you by email without delay.
You can also notify us of your decision by an unambiguous statement sent to contact@backtrex.com, or use the model form reproduced below.
If you withdraw, the amount paid is refunded in full no later than fourteen (14) days after we receive your decision, using the same payment method as for the order, and the license is withdrawn.
The right of withdrawal comes in addition to the statutory guarantee of conformity and to the refunds described in our refund policy.

Purchases billed outside the European Union, the EEA and the United Kingdom

When your purchase is billed in another country, the license gives you immediate and full access to the service and is non-refundable, subject to:

the guarantees the law of your country grants you and that cannot be waived, in particular when the service does not work as described;
any right of withdrawal the law of your country grants you: Paddle, which collects the payment, applies it on request. Write to contact@backtrex.com or contact Paddle from your receipt;
the commercial gestures described in our refund policy.

Purchases made before October 3, 2026 remain governed by the terms in force on the day of purchase, which granted a fourteen (14) day withdrawal period whatever the country.

Refunds and withdrawal of the license

A full refund of a license price, whatever its reason (withdrawal, statutory guarantee of conformity, goodwill gesture), or a payment dispute with your bank, withdraws the license. Its number is never reassigned.
A refund of a Pro to Max upgrade payment returns the license to Pro. It keeps its number and its tier.
Once the license is withdrawn, your account keeps your strategies and backtests but loses access to paid features, unless it also has an ongoing subscription.

Subscriptions taken out before the lifetime license

Pro and Max subscriptions taken out before the lifetime license went on sale, including trials in progress on that date, keep running and remain governed by the terms in force on the day they were taken out, until they are cancelled. They can be cancelled at any time from Settings > Subscription > Cancel, or from the Paddle customer portal.

Statutory guarantee of conformity

The service supplied is a digital service within the meaning of articles L. 224-25-1 et seq. of the French Consumer Code. Accordingly:

We must supply a service that conforms to the contract and to the qualities you may legitimately expect, and we are liable for any lack of conformity arising throughout the supply period.
Where the service does not conform, you may require it to be brought into conformity free of charge and within a reasonable time. If that is impossible, refused or delayed, you may obtain a price reduction or termination of the contract with a refund.
These guarantees apply regardless of any goodwill gesture we may make. Nothing in these Terms may exclude or limit them.

Intellectual property

The Backtrex platform, its source code, design, algorithms and content are the exclusive property of Stemya Tech. The strategies you create belong to you. Exported code (Pine Script, MQL5) is generated by our proprietary algorithms and licensed to you for your personal use.

Limitation of liability

Backtrex is a simulation tool. To the extent permitted by law, we cannot be held liable for:

Financial losses resulting from trading decisions made on the basis of backtest results, the user remaining solely responsible for their own trades
Temporary unavailability of the service for scheduled maintenance or in the event of force majeure
Inaccuracies in historical data supplied by third-party providers, insofar as they are beyond our control
Differences between simulated results and actual performance in real market conditions

In any event, our contractual liability is capped at the amount you actually paid for your license, including any upgrade to Max. Nothing in these Terms excludes or limits our liability for wilful misconduct or gross negligence, nor the statutory guarantees owed to consumers.

Account deletion and suspension

You may delete your account at any time from your settings. As the license is attached to your account and cannot be transferred, deleting the account ends the license. Deleting an account does not waive any refund owed to you.

Stemya Tech may suspend or delete an account in the event of an established breach of these Terms, after prior notice stating the reason and allowing a reasonable time to remedy it, except where the security of the service is seriously at risk or where required by law.

Changes to these Terms

Stemya Tech may amend these Terms to reflect legal or technical developments or changes to its offer. Any substantial change is notified to you by email at least thirty (30) days before it takes effect. A change cannot reduce, without your consent, the essential characteristics of the license you purchased, in particular its duration and its usage quotas. The terms applicable to your purchase are those in force on the day of that purchase.

Complaints and consumer mediation

Any complaint may be sent to contact@backtrex.com. We undertake to respond within fourteen (14) days.

In accordance with article L. 612-1 of the French Consumer Code, if your complaint has not been resolved to your satisfaction, you may refer the matter free of charge to a consumer mediator with a view to an amicable settlement, within one year of your written complaint.

Governing law and jurisdiction

These Terms are governed by French law. As a consumer, you retain the benefit of the mandatory provisions of the law of your country of habitual residence. In the event of a dispute, you may bring proceedings before the courts of your domicile or those of Stemya Tech's registered office, at your choice; we may only bring proceedings against you before the courts of your State of residence.
